Solutions Affiliate End User Agreement

PLEASE READ THIS AGREEMENT BEFORE USING SPLASHMETRICS’ SERVICES. BY ACCESSING OR USING SPLASHMETRICS’ SOFTWARE OR SERVICES OFFERING(S), YOU SIGNIFY ACCEPTANCE OF AND AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT, DO NOT ACCESS OR USE THE SERVICES.
AFTER CAREFULLY READING THIS AGREEMENT, COMPLETE THE FORM BELOW TO EXECUTE THE AGREEMENT.
You acknowledge herein that you, the Splashmetrics Solutions Affiliate, are the approved agent acting on behalf of your client’s/customer’s business, and are entering into an agreement with Splashmetrics to provide Splashmetrics’ Software and/or Services to your client/customer, referred to herein as the Solutions Affiliate End User (“End User”).
Therefore, this is a contract between you, the End User, and us (Splashmetrics). The terms and conditions referenced below are detailed in the Splashmetrics Software as a Service Agreement.
By submitting the form below, you hereby acknowledge and agree to the following:
1. SaaS Agreement
You and End User have read and agree to the Splashmetrics Software as a Service Agreement (“SaaS Agreement”).
2. Approval of Agent and Agreement
You hereby declare that End User has given you full approval and authority to enter into the SaaS Agreement on its behalf, and that End User will also fully abide by the terms and conditions therein.
3. Approval of Agent’s Administration
For the duration of the Subscription Term, and unless otherwise directed by End User to Splashmetrics in writing, you hereby acknowledge that you have full approval from End User to act as the Administrative User, and to manage all its content and data on its behalf as detailed in the SaaS Agreement.
4. End User Representative
Via the form below, you are providing, with End User’s knowledge and approval, the information below for the End User Representative. This information will allow us to establish a required user account (Administrative-Level Access) for the End User Representative in the Customer Account, so they may have full access to the software and/or services. This user account will be a standard Platform User, and will count toward the number of Platform Users detailed in the Saas Agreement Schedule.

IN WITNESS THEREOF, the parties have executed this Agreement as of the following Effective Date.
